本文通过查阅英美法系和大陆法系对于侦查人员出庭作证制度的相关规定，并对我国侦查人员出庭作证的现状、特点，以及出现这种现象的原因进行概括、总结，分析出在我国实施正查人员出庭作证制度的可行性和必要性，最终提出构建该制度的一些建议。除了通过立法规范侦查人员出庭作证的证人资格、作证范围、作证程序外，本文还提出了对于拒绝出庭作证的侦查人员采用惩罚措施以保证制度的实施，且有助于带动普通证人出庭作证，形成良好的社会风气，最终实现司法程序和实体的双重正义。

　　In this paper,we has consulted the relevant provisions of system of investigators testifying in court in Common-Law System and Civil-Law System,summarized the situation,fingerprint and the reasons for this phenomenon of the system in our country,analyzed that the necessity and feasibility to carry out the system in our country.Finally,we can proposed some suggestions about building this system.In this paper,in addition to suggest standardize the competence,scope and the procedure of the investigators testified in court by legislation,the author set forth some measures to punish investigators who refuses to testify in court that for ensuring the implementation of the system.This will help to promote common witness to testify,to form a good social atmosphere,and ultimately to achieve judicial justice of both entity and process.
