但是，这并不是一项轻松的“工程”，而需要广大执法立法工作者的同心协力。要在我国设立国家侵权精神损害赔偿，是存在着一定的实践上的难度的，譬如如何计算赔偿金额，明确精神损害的认定标准，怎样在普遍施行精神赔偿的同时，不给国家机关工作人员带来过大的思想压力而导致工作效率的降低，怎样面对因此而催生的各种民众情绪问题等等。
